The Sovereign Living Souls of  the Commonwealth of Australia.

State and Territory Legislative Councils Two Members in each Province.

GOVERNMENT is this Treason or terrorism?
The Party or group of Members who can maintain the confidence (a majority of votes) of the House.
The Government is also seen as every Member supporting the parliamentary majority.
CABINET is this Treason or terrorism?
A maximum of eight Members of the Parliament who have been commissioned as Ministers by the
Governor to be responsible for a ministry or government agency or to administer certain Acts.
There shall be no such office of government or cabinet or
department of prime minister and cabinet or department of premier and cabinet
in any Federal or State or Territory Government or Parliament in Australia.

(1). Federal Executive Government;
The Executive Government of the Commonwealth is the Authority in the Living Souls of Australia
and is exercisable by the Head of the Commonwealth as the representative of the
Living Souls of Australia and extends to the
execution and maintenance of this Constitution and of the laws of the Commonwealth.
.
(2). No member of any political party or group or corporation in the Commonwealth of Australia or any
other Country shall be chosen to serve on the Federal Executive Council.
One member shall be chosen and summoned in each State and Territory from
Each State and Territory Executive Council.
.
(3). One Living Soul from each State and Territory shall each represent their individual State
and Territory in the Federal Executive Council. The Living Souls shall not be members of the
House of Representatives or of the Senate or representatives of any political Party in Australia.

(4). People as the source of authority:
 That all political authority is inherent in the people and all free governments are founded on their
authority and instituted for their benefit.
Shall have at all times not capable of being transferred that can not be forfeited or done away with.
No public authority shall pressure Parliament to Legislate any law. The Parliament shall not announce
any scare campaign to help force any Legislation through the Parliament.

(5). If the People are protesting in the Streets in any one City or all Cities in Australia the
Head of the Commonwealth shall issue a writ to hold a Referendum subject to Chapter Eight of this
Constitution and the decision of the Living Souls shall be final.

(6). Objective of government
That the sole object and only legitimate end of government is to protect the Living Souls in the
enjoyment of life and liberty and property and prosperity.

(7). The laws do not apply to the Queen or King of England but apply to the Living Souls of Australia;
for this reason the Living Souls shall replace the Crown the Queen or King of England as the Sovereign.

62. It is obvious that the Australian people do not trust politicians.  The people want some control over
their destiny. This shall be the Authority of the Living Souls to the Head of the Commonwealth in
council with the Federal Executive Council to initiate one of the following:

Citizen Initiated Referendum;
The right of the people to demand and initiate laws they want and need.
The Australian Living Souls will from this day forth and for all times to come have the
right to direct the Parliament at a federal and State level to hold a referendum on an issue
which is of great concern to them. Head of the Commonwealth shall cause Letters to be
written to the Living Souls at minimum age of 18 years in each Electorate in each of their
States and Territories and issue the writ to hold a Referendum.
If Referendum results in 51% of Electors vote Yes the legislation shall be put into force.

Voter Veto Referendum;
The power to stop bad legislation before it can become law.
The Australian people will from this day forth and for all times to come have the right to
direct the Parliament at a federal State level to hold a referendum not to proceed with
intended legislation. Head of the Commonwealth shall cause Letters to be written to the
Living Souls at minimum age of 18 years in each Electorate in each of their States and
Territories to issue the writ to hold a Referendum. If Referendum results in 51% of
Electors agree to stop the proposed legislation
the Parliament shall not proceed with the proposed legislation.

Recall Referendum;
The power to dismiss any Head of the Commonwealth or Head of the State or
politician or public servant or member of the Judicature or judiciary without
having to wait three years.
The Australian people will from this day forth and for all times to come have the right to
direct the Parliament at a Federal or State level to hold a referendum to dismiss and or
prosecute any elected or appointed government official by gathering a petition of one
percent of eligible voters. Send the Petition to the Head of the Commonwealth who shall
cause Letters to be written to the People at minimum age of 18 years in each Electorate
in each of their States and Territories to issue the writ to hold a Referendum.
If Referendum results in 51% of Electors agree the official shall be dismissed.

Shall abolish all Federal Electorates and Elections;
(1). All Federal Electorates and Elections shall be abolished but all existing State and Territory
Legislative Council and Legislative Assembly electoral boundaries shall remain as is and
all City Provinces and Districts shall be reduced to three Metropolitan Provinces and Districts.

(2). There shall be two Members of each State and Territory Legislative Council appointed to
serve as Senators. The Senators shall be the Constitutional opposition.
There shall be two Members of each State and Territory Legislative Assembly appointed to
serve as House of Representatives.

63. Federal and State and Territory Parliaments;
Each Member of the Federal Senate and House of Representatives and State and Territory
Legislative Council and Assembly shall nominate as Independent Candidates by completing a
Nomination form and have the Living Souls put their Name and Address and Signature on that
Nomination form.
Each Member of the Federal Senate and House of Representatives and  State and Territory
Legislative Council and Assembly shall not be members or representatives of any political party or
group or corporation or company in or outside Australia or Federal or State or Territory public service.

Sitting of Federal Parliament;
(1). The Head of the State of each State and Administrator for each Territory shall consult the
Head of the Commonwealth to advise the next sitting of the Federal Parliament.
.
Head of the Commonwealth shall contact the Head of the State of each State and the
Administrator of each Territory to appoint two members of the Legislative Council to be members
of the Senate and two members of the Legislative Assembly to be members of the
House of Representatives. To assemble for a joint sitting of both Houses of the Federal Parliament.

The Head of the Commonwealth shall then set a date to advise the Senators and
House of Representatives and the Public of the next sitting of the Federal Parliament.

64. Annual Salary of Head of the Commonwealth;
There shall be payable out of the Consolidated Revenue Fund of the Commonwealth for the salary
of the Head of the Commonwealth and Deputy Head of the Commonwealth an annual sum which the
Parliament provides. The salary of the Head of the Commonwealth or
Assistant Head of the Commonwealth shall not be altered during their continuance in office.

Annual Salary Executive Council and Public Ministers;
Shall be payable out of the Consolidated Revenue Fund of the Commonwealth for the salary
of members of the Executive Council and Public Ministers an annual sum the Parliament provides.
The salary of which shall not be altered during their continuance in office.

Annual Salary Military and Police Unit and Natural Disaster Unit;
There shall be payable out of the Consolidated Revenue Fund of the Commonwealth for the salary
of members of the Military Personnel being the army and navy and air force and Police Unit and
Natural Disaster Unit an annual sum the Parliament provides.
The salary of which shall not be altered during their continuance in office.

There shall be only one Federal Government and one State Government or Territory Government.
No other Government such as Local Government shall exist in Australia.
There shall be no statutory authority or statutory authorities or statutory tribunals.
Statutes or Statutory Authorities and or Tribunals shall not have any Jurisdiction or lawful authority
in the Commonwealth of Australia.

65. Head of the Commonwealth;
The provisions of this Constitution relating to the Head of the Commonwealth and
Deputy Head of the Commonwealth extend to a person performing the duties of
Head of the Commonwealth and Deputy Head of the Commonwealth.
The Head of the Commonwealth and Deputy Head of the Commonwealth shall not be entitled to
receive any salary from the Commonwealth in respect of any other office during their term of office.

Chief Justice or any one of the other Justices of the High Court shall be the only Living souls who may
apply for the position of  Head of the Commonwealth. Shall have first preference for the appointment
by Referendum of the Living Souls of the Commonwealth to hold the office of the
Head of the Commonwealth. Shall not hold the office of Head of the Commonwealth while employed
as Chief Justice or other Justices of the High Court.
Shall extend to the execution and maintenance of this Constitution and
of the laws of the Commonwealth.

Head of the Commonwealth shall be representative of and directly chosen by the
Living Souls of and in the Commonwealth and shall have and may exercise in the
Commonwealth under the authority of the Living Souls but subject to this Constitution such powers
and functions the Living Souls may be pleased to assign to the Head of the Commonwealth and shall
include where the Living Souls may disallow any law within one year from the
Head of the Commonwealth's assent and a proposed law reserved for the Referendum of the
Living Souls shall not have any force until it has been accepted by the Living Souls.

The Living Souls shall be chosen and summoned by the Head of the State and declared as
Executive Councilors and the members of the Federal Executive Council shall advise the
Head of the Commonwealth and Deputy Head of the Commonwealth in the government of the
Commonwealth. Shall hold office during the Authority of the Head of the Commonwealth.
.
Constitutional Head of the Commonwealth shall be known as the Head of the Commonwealth
and when in Parliament shall be known as the Head of the Commonwealth in Parliament.
.
No Legislation shall become Law unless it has been assented to by the
Head of the Commonwealth in council with the Federal Executive Council.
The Head of the Commonwealth in council with the Federal Executive Council may also be referred
as the Head of the Commonwealth in council and may include the Head of the Commonwealth acting
with the advice of the Federal Executive Council.

The Head of the Commonwealth in Council with the Executive Councilors shall be the
only authority for the appointment of High Court Chief Justice and Justices of the High Court and
Magistrates and Judges of the Supreme Court of law.
Ambassadors and consuls and the departments of and the public ministers as established
by this Constitution. Shall be the only Jurisdiction in the Commonwealth of Australia.

Shall be no Statute law or laws or tribunal or tribunals as these are opposite to and
shall not be part of this Constitution.
.
The appointment and removal of all other officers of the Federal Executive Council of the
Commonwealth shall be the authority of the Head of the Commonwealth.
The Federal Executive Council shall represent each Electorate of the Commonwealth.
.
The appointment and removal of all officers of the Commonwealth Public Ministry shall be the
authority of the Head of the Commonwealth in Council with the Federal Executive Council.
The Public Ministry of the Commonwealth shall be a part of the Public Service.
.
The Head of the Commonwealth with the advice of the Federal Executive Council may appoint
the Assistant Head of the Commonwealth to be the Head of the Commonwealth's deputy within any
part of the Commonwealth and in that capacity to exercise such powers and functions of the
Head of the Commonwealth as assigned to the Assistant Head of the Commonwealth but the
appointment of the Assistant Head of the Commonwealth shall not affect the exercise by the
Head of the Commonwealth of any power or function.

The Head of the Commonwealth shall be command in chief of the Police Unit to execute and maintain
the laws of the Commonwealth of Australia is the absolute authority in the Head of the Commonwealth
acting with the advice of the Senate shall convene a joint sitting being the Parliament of the members
of the Senate and of the House of Representatives in all Police Unit decisions.

The Head of the Commonwealth shall be command in chief of the defence forces of the
Commonwealth and all munitions manufacture and supply is the absolute power and authority in the
Head of the Commonwealth acting with the advice of the Senate shall convene a joint sitting being
the members of the Senate and of the House of Representatives in Parliament in all
defence forces decisions.

All Military Personnel being the army and navy and air force shall be paid the equivalent
and minimum that is the basic wage as paid to workers and free rent if living in public
housing. If injured shall be given first priority and compensation a minimum of $500,000.
If retired from all military service and other employment each individual Military person
shall be paid the equivalent Age pension as paid to a married couple.
The Head of the Commonwealth acting with the advice of the Senate shall convene a joint sitting
being the Parliament of the members of the Senate and of the House of Representatives
shall declare war to defend Australia should any country that uses it's forces to initiate a
direct armed military attack on this country Australia.

The Head of the Commonwealth shall convene a joint sitting of the members of the Senate and of
the House of Representatives that if another country asks for assistance shall issue the Writ for
a Double Majority Referendum for the assent of the People of Australia to declare war on a country
that is not a direct threat to Australia. The decision of the People of Australia shall be final
.
66. Head of the Commonwealth and Natural Disasters;
If the situation is urgent, the Head of the Commonwealth shall have the immediate authority to use the
defence forces to organize water and food and shelter for the Living Souls of Australia and overseas
against bush fires or flood or wind or storm damage or volcano or Tsunami or tidal wave damage.
The Head of the Commonwealth shall convene a joint sitting being the Parliament and of the members of
the Senate and of the House of Representatives to plan follow up action to help bring the
Community back to normal.
The Head of the Commonwealth shall form a specially trained force of People who are not employed
and aged less than 50 years to serve in Australia and overseas in time of need, help those People
affected by Natural Disasters.

Departments transferred to or part of the Commonwealth;
After the establishment of the Draft of this Constitution, the Head of the Commonwealth shall proclaim;
the following departments of the public service in each State shall become
transferred to the Commonwealth:--
This Land of Australia and all underground and mined Resources:
Posts and telegraphs and telephones:
Naval and military and Air Personnel. All munitions manufacture and supply:
Lighthouses and lightships and beacons and buoys and railways:
Quarantine:
Lakes and All Streams and Ocean Foreshore and Bays:
Water from Underground Pumped or Mined or Spring Water shall not be for sale to any
Corporation and or exported to any overseas destination but shall be available free to the
People and or pumped to the nearest stream that flows into a Dam or town clean water supply.
.
All Crown and Waste Lands shall be transferred to the Commonwealth of Australia and that
any decision by the Parliament effecting all Crown and Waste Lands shall be subject to a
Referendum of the Living Souls of Australia in accordance with Chapter 8 of this
Constitution and that the Aboriginal community must be consulted before any
decision is complete.
In respect of matters which under this Constitution pass to the Head of the
Commonwealth in Council with the Executive Council and all powers and functions which at the
establishment of the Commonwealth is the authority in the Governor of a Colony or in the
Governor of a Colony with the advice of the Governor's Executive Council shall be the authority in
the Head of the Commonwealth in Council with the Executive Council.

No person except a natural born citizen shall be eligible to the office of  Head of the Commonwealth
and Deputy Head of the Commonwealth and Head of the State and neither shall any person be eligible
to that office who shall not have attained to the age of thirty five years and ten years a resident and
remains a resident during the full term in office of  The Head of the Commonwealth and
Head of the State in this country of Australia.

In case of the removal of the Head of the Commonwealth from office or of his death or resignation or
inability to discharge the powers and duties of the said office then the Parliament may by this
Constitution provide for the case of removal declaring the Deputy Head of the Commonwealth shall
then act as Head of the Commonwealth, and the Deputy Head of the Commonwealth shall act
accordingly until the disability be removed or a Head of the Commonwealth shall be elected.
.
The Head of the Commonwealth shall not be removed except by address from all members of both
Houses of the Parliament in the same session and praying for such removal on the ground of proved
misbehavior or incapacity.
The Head of the Commonwealth shall make public announcement of any removal.
The Head of the Commonwealth if removed shall cease to hold office.
.
The President of the Senate and the Speaker of the House of Representatives may resign the office by
writing addressed to the Head of the Commonwealth.  Such resignation shall take effect at the time
specified by The Head of the Commonwealth.
.
If the Head of the Commonwealth has been removed or has resigned from the office of
Head of the Commonwealth, the Deputy Head of the Commonwealth shall replace the
Head of the Commonwealth for a maximum period of 90 days after the vacancy occurs and shall
then act as Head of the Commonwealth and the Deputy Head of the Commonwealth shall act
accordingly in accordance with this Constitution.
The Speaker of the House of Representatives shall within 90 days after the vacancy occurs propose
a Referendum for the position as Head of the Commonwealth and
Deputy Head of the Commonwealth in accordance with this Constitution.

The first Head of the Commonwealth shall be the person occupying the position of
Governor General at the date of the enactment of this Constitution.
.
The term of office of the Head of the Commonwealth begins at the end of the term of office of the
previous Head of the Commonwealth. But if the office of Head of the Commonwealth falls vacant, or
the term of office of the out going Head of the Commonwealth ends, before the day on which the
incoming Head of the Commonwealth makes the oath or affirmation of office, the incoming
Head of the Commonwealth's term of office begins on the day after that day, but if at the end of the
term, a new Head of the Commonwealth does not take office, the office of
Head of the Commonwealth does not fall vacant and the out going Head of the Commonwealth
continues as Head of the Commonwealth until the term of office of the next
Head of the Commonwealth begins.

During any vacancy in the office of the Head of the Commonwealth or during the absence from
Australia of the Head of the Commonwealth the duties and functions of the
Head of the Commonwealth shall be undertaken by the Deputy Head of the Commonwealth.

THE MINISTRY
Part Five -- Section 67.
.
The Public Ministry of the State for the Commonwealth.
.
(a). The Public Ministry of the Commonwealth is the authority in the People of Australia and
is exercisable by the Head of State as the representative of the People of Australia, and
extends to the execution and maintenance of this Constitution, and of the laws of the Commonwealth.
There shall be no Statutory Authority or Tribunal.
.
(1). The qualification of Public Ministers
.
 A comprehensive requirement shall include:
 theoretical and constitutional aspects of a ministers role
 ministerial responsibility and accountability
 what to expect, and request, by way of initial briefing
 time management and control over the diary
.
 the relationships between a minister and the public sector including department,
    in relation to legislation, other agencies and contractors to government
.
 relationships with other ministers and their staff
 handling deputation's and individuals making representations
.
 public sector management
 relationships with the media
.
 intergovernmental relations
 maintaining links and service to the People.
.
(c). There are totally subjective criteria the Head of State of Australia or State Governor or
Territory Administrator has to exercise from time to time, should he or she be satisfied or unsatisfied
with the performance of various public ministers.
.
(d). One of the most delicate issues for any minister is that of staffing the private office and establishing
the relationships between the minister, the private office and the agencies for
which he or she is responsible.

(e). Because of the changing nature of Parliament through elections and re-shuffles; that no
Public Minister shall be a part of Parliament or be members of any Political Party. All legislation is law,
including all agreements with other countries. All Public Ministers shall be appointed from practicing
members of their profession where each will have their private offices and staff.
.
(f). The private office of all Public Ministers shall have an Australian business registration period of a
minimum of five (5) years and no connections with any overseas group.
.
(g). There shall be Nine Public Ministry Departments, and the members of the Ministry shall
be chosen and summoned by the Head of State in Council with the Senate and, declared as
Public Ministers for a period as determined by the Head of State in Council with the
Federal Executive Council.

(2) The nine Public Ministry Departments include;
1. Department of; Treasury, Banking, Stock Exchange and Futures Exchange.
2. Department of; Issue of Bill of Exchange, Legal tender, Currency Notes and Coins.
3. Department of; Overseas Trade, All Corporations and Companies.
4. Department of; Manufacturing, Transport, Small Business, Farming, Mining.
5. Department of; Environment, Water, Salinity and waste water management.
6. Department of; Constitution, Legislation, Judiciary, Inter-State Commission.
7. Department of; Foreign relations, Agreements, Treaties, Quarantine, ports and harbors.
8. Department of; All Railways, Roads, Communications, Post and Telephone.
9. Department of; Immigration, Refugees and Conciliation, Tourism.
10. Department of; Family, Health, Hospitals, Education, Universities.
(h). The members of the Public Ministry, must be a natural born Australian Citizen or is at
least five years naturalized Australian Citizen under the law of the Commonwealth.
The business and individuals must be resident in Australia.

(i). The Head of the Commonwealth shall require the opinion in writing of the principal officer in each
of the Public Ministers and upon any subject relating to the duties of their respective offices.
.
(j). The Head of the Commonwealth shall appoint High Court Justices or Magistrates or Solicitors who
were Senators or Members of the House of Representatives but are not in any office of profit under or
of the Parliament and have not been re-elected may accept the appointment in the Public Ministry.
.
(k). The Head of the Commonwealth shall appoint a qualified Chartered Accountant as
Public Minister to administer the Consolidated Revenue Fund of the Commonwealth.
Chartered Accountant shall act as Treasurer subject to Chapter 4 Finance and Trade.
.
(L). The Chartered Accountant as Public Minister shall have access to all financial statements to the
Consolidated Revenue Fund of the Commonwealth and shall report to the Head of the Commonwealth
in Council with the Federal Executive Council of all finance into being held and expenses of the
Consolidated Revenue Fund according to this Constitution.
.
(m). Role of the Public Ministry is to administer such ministerial Departments of State of the
Commonwealth only and shall not become Leader of the Commonwealth shall be individually
responsible to the Head of the Commonwealth in Council with the Federal Executive Council.
.
(n). The Public Ministry shall only administer the Ministry they have been appointed to and
may sit in the House of Representatives when requested to discuss the Ministry and the
effect of any legislation on the Ministry.
.
(o). Public Ministers of State for the Commonwealth shall have no power and or authority
over the Senate or the House of Representatives and shall not be a member of the Senate or
the House of Representatives or initiate any legislation.
.
(p). Public Ministers of State shall hold such offices as the Head of the Commonwealth in Council
with the Federal Executive Council appoints. They shall be members of the Public Ministry only and
shall be Public Ministers of State for the Commonwealth.
.
(q). The Public Ministers may apply for any alteration to the salary if again the Public
Minister or Public Ministers have been appointed.
.
(r).  A vote or resolution or proposed law for the appropriation of revenue or moneys shall not be
passed unless the purpose of the appropriation has been recommended by message of the
Head of State to the House in which the proposal originated.
.
For there is no ordinance except of God.
All Politicians take heed: the wishes of the Living Souls is irresistible. The Executive Government of the
Commonwealth is the Authority of the People of Australia. In a democracy, Sovereignty rests with the
Living Souls being the Electors. The Executive chosen by the Head of the Commonwealth for the
execution of this Constitution and of the laws of the Commonwealth; is ordained by God.

To be removed;
Upon the passage, with the concurrence of at least two thirds of all the senators and of the
House of Representatives of a resolution to remove the Head of the Commonwealth,
Deputy Head of the Commonwealth and all civil officers and any one member of both
Houses of the Parliament of Australia, after a meeting of all members of both
Houses of Parliament; shall be removed from office, should any one person be guilty for and
conviction of, treason, bribery, or other high crimes and misdemeanors.

THE REFERENDUM OF THE HEAD OF COMMONWEALTH.

68. A Head of the Commonwealth by Referendum of the Sovereign Living Souls of Australia shall be
representative of and directly chosen by the Living Souls and Head of the Commonwealth and head
of Parliament in or of the Commonwealth and shall have and may exercise in the Commonwealth but
subject to this Constitution and these Our Letters Patent and Bill of Rights 1689 such powers and
functions the Sovereign Living Souls of Australia may be pleased to assign to the
Head of the Commonwealth.

The Speaker of the House of Representatives may in a joint sitting of the Members of the Senate and
the House of Representatives invite a maximum of five volunteers from the national electorate for
election as Head of the Commonwealth together with the Deputy Head of the Commonwealth shall
hold that office until the expiration of three or six years from the date of his or her term by
Referendum or his or her death resignation or removal in accordance with this Constitution.
.
The period the Head of the Commonwealth and the Deputy Head of the Commonwealth term of office
shall be according to the election of the House of Representatives when the Referendum would be held
at same time as the election of the House of Representatives every three years.

Is qualified to be chosen as Head of the Commonwealth and Deputy Head of the Commonwealth if;

      (a) the person is qualified to be and capable of being chosen as a member
          of the House of Representatives and
     .
      (b) the person is not a member of the Commonwealth Parliament or a
          State Parliament or Territory legislature or a executive of a political party
          or from Priest through to Head of any religion.

No member of the Senate or House of Representatives or person holding an office of trust or profit
under Parliament shall nominate for position as Head of the Commonwealth or
Deputy Head of the Commonwealth.

The Head of the Commonwealth must be an Australian citizen entitled to vote for the election of
members of the House of Representatives.
.
The main stages:
A referendum must be held no sooner than two and no later than six months after the proposal has
been passed by Parliament. The Parliament may determine the day of the National Referendum shall
be held on the same day in each of the Australian States.
The five Living Souls shall be put to a National Referendum of the People.
Must be approved by a double majority that is:
a national majority of electors; the person having the greatest number of votes shall be the
Head of the Commonwealth.
But if there be more than one who have such majority and have an equal number of votes then a
majority of the States and Territories shall be added to decide the Head of the Commonwealth.
The candidate with the second highest number of votes shall be the
Deputy Head of the Commonwealth who shall replace the Head of the Commonwealth if the
Head of the Commonwealth is unable to perform the duties of Head of the Commonwealth.

THE BILL OF RIGHTS 1689.
69. Head of the Commonwealth;
The Head of the Commonwealth shall cause Letters to be written to Members of the Senate and
House of Representatives and other Letters to the People at minimum age of 18 years in each
Electorate in each of their States and Territories; for the choosing of such persons to represent them
as were of right to be sent to Parliament to meet and sit at Parliament House Canberra.
In order to such an Establishment as that their Religion and Laws and Liberties and Property and
Prosperity might not again be in danger of being subverted upon which Elections having
been accordingly made.

The Parliament;
And upon the said Parliament pursuant to their respective Elections being now assembled in a full and
free Representative of this Nation Australia taking into their most serious consideration the best means
for attaining the ends do in the first place for the vindicating and asserting their ancient Rights and
Liberties Declare;
That the pretended Power the suspending of Laws or the Execution of Laws by
Authority without Consent of Parliament is illegal.

That the pretended power of dispensing with Laws or the Execution of Laws by
Authority as has been or may be assumed and or exercised is illegal.
.
That the Commission for erecting the late Court of Commissioners for
Ecclesiastical Causes (body formerly administering part of church) and all other
Commissions and Courts of like nature are illegal and pernicious.
.
That levying money for or to the use of the Head of State by pretense of Prerogative without
Grant of Parliament for longer time or in other manner than the same is or
shall be granted is illegal.
.
That it is the right of the Subjects to petition the House of Representatives, that all
Commitments and prosecutions for such petitioning, are illegal.
.
That the raising or keeping a Standing Army within the Commonwealth in time of
Peace unless it be with Consent of Parliament is against Law.
.
That the Subjects may have weapons for their defence suitable to their Conditions
and as allowed by Law.
.
That Election of Members of Parliament ought to be free.
.
That the Freedom of Speech and Debates or Proceedings in Parliament ought not to
be impeached or questioned in any Court or Place out of Parliament.
.
That excessive Bail ought not to be required nor excessive Fines imposed nor
cruel and unusual Punishments inflicted.
.
That Jurors ought to be duly impaneled and returned and Jurors which pass upon
men in Trials for high Treason ought to be Electors.
.
That all Grants and Promises of Fines and Forfeitures of particular persons before
Conviction are illegal and void.
Redress of all Grievances;
And that for Redress of all Grievances and for the amending strengthening and
preserving of the Laws Parliaments ought to be held frequently.
And they do claim demand and insist upon all and singular the premises (previously said in
this document) as their undoubted Rights and Liberties.

And that no Declarations or Judgments or Doings or Proceedings to the prejudice (impair the
validity of right) of the People in any of the said premises (previously said in this document) ought
to be drawn into any Consequence or Example.

Declaration of the Head of the Commonwealth;
The Head of the Commonwealth shall as soon as practicable after entering upon the office make
and subscribe publicly the following AFFIRMATION:
"I, [name] do solemnly and sincerely affirm and declare true allegiance to the
Sovereign People of Australia the Bill of Rights 1689 the Commonwealth of Australia Constitution
Act this Land and to this Country and a manufacturing base in Australia"

To which Demand of their Rights they are particularly encouraged by the Declaration of the
Head of the Commonwealth as being the only means for obtaining a full Redress and Remedy in that
respect in or of this and

Having an entire Confidence that the said Head of the Commonwealth will perfect the Deliverance so
far advanced by him or her and will still preserve them from the violation of their Rights which they
have here asserted in this the Bill of Rights 1689 and from all other attempts upon their
Religion and Rights and Liberties and Prosperity.

Letters Patent Constituting the office of
Head of the Commonwealth and Head of the State.

70. The Sovereign Living Souls of Australia by the Grace of God. To all to whom these Letters Patent
shall come Salutations.
By an Act of Parliament passed and intituled An Act to constitute the Commonwealth of Australia it is
enacted that it shall be lawful for the Living Souls with the advice of the Executive Council to declare
by Proclamation that on and after a day appointed not being later than one year after this passing of
this Act the Living Souls of New South Wales and Victoria and South Australia and Queensland and
Tasmania and Western Australia and the Northern Territory and the Australian Capital Territory
shall unite in one indissoluble Federal Commonwealth under the name of the
Commonwealth of Australia.
But the Living Souls may at any time after Proclamation appoint a Head of the Commonwealth:

We did by and with the advice of Our Executive Council declare by proclamation that on and after
the first day the Living Souls of New South Wales and Victoria and South Australia and Queensland
and Tasmania and Western Australia and the Northern Territory and the Australian Capital Territory
shall be united in one indissoluble Federal Commonwealth under the name of the
Commonwealth of Australia:

And by the said recited Act certain powers and functions and authorities were declared to be the
authority in the Head of the Commonwealth and We are desirous of making effectual and permanent
provision for the office of Head of the Commonwealth and Commander in chief in and over the said
Commonwealth of Australia without making new Letters Patent on each demise of the said office that
.
We have thought fit to constitute order and declare and do by Our Letters Patent constitute order
and declare that there shall be a Head of the Commonwealth and Commander in Chief called the
Head of the Commonwealth in and over the Commonwealth of Australia called the said
Commonwealth and that the person who shall fill the said office of Head of the Commonwealth shall
be from time to time be the representative of the Living Souls and elected by
Referendum of the Living Souls.

And we do hereby authorize and command Our said Head of the Commonwealth to do and execute
in due manner all things that shall belong to the Head of the Commonwealth said command and to the
trust We have placed in the Head of the Commonwealth according to the several powers and
authorities granted or appointed him by virtue of  the Commonwealth of Australia Constitution Act
1900 and of these presents Our Letters Patent and of such Commission as may be issued to him and
according to such Instructions as may from time to time be given to him or by Our Order in
Our Executive Council of The Sovereign Living Souls of Australia and to such laws as shall continue
to be in force in the said Commonwealth.

2. There shall be a Great Seal of and for the said Commonwealth which the said
Head of the Commonwealth shall keep and use for sealing all things that shall pass the said Great Seal.
Provided that until a Great Seal shall be provided the Private Seal of Our said
Head of the Commonwealth may be used as the Great Seal of the Commonwealth of Australia.

3. The Head of the Commonwealth may constitute and appoint in the name of and on behalf of
The Sovereign Living Souls of Australia and all such High Court Judges and State Magistrates and
Commissioners and Justices of the Peace and other necessary officers and Ministers of the said
Commonwealth as may be lawfully constituted or appointed by the Living Souls.

4. The Head of the Commonwealth and so far as We the Sovereign Living Souls of Australia
Ourselves lawfully may upon sufficient cause to him appearing, may remove from his or her office or
suspend from the exercise of the same any person exercising any office of the said Commonwealth
under or by virtue of any Commission or Warrant granted or which may be granted by Us in
Our name or under Our authority and;

5. The Head of the Commonwealth may on Our behalf exercise all powers under the
Commonwealth of Australia Constitution Act in respect of the summoning and proroguing or dissolving
the Parliament of the said Commonwealth.

6. And by The Commonwealth of Australia Constitution Act it is amongst other things enacted that we
may authorize the Head of the Commonwealth to appoint any person to be his Deputy within any part
of the Commonwealth and in that capacity to exercise during the authority of the
Head of the Commonwealth such powers and functions of the said Head of the Commonwealth as he
or she thinks fit to assign to such Deputy subject to any limitations expressed or directions given by
The Sovereign Living Souls of Australia:

Now We the Sovereign Living Souls of Australia do authorize and empower Our said
Head of the Commonwealth subject to such limitations and directions as aforesaid to appoint any
person to be his or her Deputy within any part of the said Commonwealth of Australia and in that
capacity to exercise during his or her authority such of his or her powers and functions as he or she
may deem it necessary or expedient to assign to him or her or them. Provided always that the
appointment of such a Deputy shall not affect the exercise by the Head of the Commonwealth himself
or herself of any power or function and that the appointment shall be a maximum period of 90 days.

7. And We the Sovereign Living Souls of Australia do hereby declare Our authority to be that, in the
event of the death or incapacity or removal or absence of the said Head of the Commonwealth out of
the said Commonwealth all and every the powers and authorities here in this Letters Patent granted to
him or her shall until Our further authority is signified in document the authority in such person as may
be appointed by Us to be Our Lieutenant Governor of the said Commonwealth or if there shall be no
such Lieutenant Governor in the said Commonwealth then in such person or persons as may be
appointed by Us to administer the Government of the same.

No such powers or authorities shall place authority in such Lieutenant Governor or such other person
or persons until he or she or they shall have taken the oaths appointed to be taken by the
Head of the Commonwealth of the said Commonwealth and in the manner provided by the
Instructions accompanying these Our Letters Patent.

8. And We do require and command all the Officers and Ministers Civil and Military and all other
the inhabitants of the said Commonwealth to be obedient and aiding and assisting unto Our said
Head of the Commonwealth or in the event of his death incapacity or absence to such person or
persons as may from time to time under the provisions of these Our Letters Patent administer the
Government of the said Commonwealth.

9. And We do further direct and enjoin that these Our Letters Patent shall be read and proclaimed at
such place or places as the said Head of the Commonwealth shall think fit in and of the said
Commonwealth of Australia.
